Subject: Motorcycle/ATV Riding

The Board has received complaints from many of the residences in Augusta about dirt bike and ATV riding in the community. Complaints range from noise pollution, disrupting the peace, speeding, and more importantly safety issues. One rider was going way too fast, went out of control, missed a corner, and ended up in someone’s driveway. One thing we don’t need is an accident involving one of these vehicles, whether it is caused by the rider or not. Chances of having an accident with the amount and kind of riding going on lately are pretty high. These issues were brought up at the last board meeting held on 14 Apr 2009. The Board has decided to take action on this issue. On 12 May 2009 the board met for its normal monthly meeting. A vote was taken on establishing a rule/regulation restricting the riding of dirt bikes and ATVs in the Plat of Augusta. All Board voting members approved to put in place the following rule/regulation and its penalty. The justification is also referenced.

Definitions:

1. Off road motorcycle - Any motorcycle that is not street legal.

2. ATV – All Terrain Vehicle, any motorcycle type vehicle that has more than two wheels and used for off road use.

3. Riders include licensed and non-licensed persons

Rule/Regulation:

1. No ATVs shall be ridden in the Plat of Augusta with only two exceptions.

a. An ATV can be used for the purpose of Plat maintenance upon approval of the Board.

b. An ATV can be ridden from its storage to be loaded on to a trailer or truck

2. No Off Road Motorcycles shall be ridden in the Plat of Augusta.

3. Fine/fines shall be $100.00 per incident. The fine/fines will be issued to the rider or the home owner where the offender lives or is visiting if not a resident. All fines not paid at the due time in the violation will be sent to collections. Late fees and interest, at the rate of 12% annum (per year) as referenced in the Covenants and Bylaws, will also be assessed on delinquent payments.

Justification:

The Augusta Plat Covenants do not address off road vehicle use on the Augusta Properties. When the Covenants were established Bylaws were also created. These Bylaws grant the Board the power to adopt and publish rules and regulations governing the use of the Properties and the personal conduct of the members and their guests thereon, and to establish penalties for the infraction thereof. (Ref: Bylaws Article 6 Section 1)
