Can my employer require me to stay in his building or on his property for lunch but not pay me for that time?

From what we've learned we believe the answer to be NO!!!

According to DWD's Labor Standard Division -

Employers must pay employees for "on duty" meal periods. An "on duty" meal period is one where the worker is not provided at least 30 consecutive minutes free from work, or where the worker is not free to leave the employer’s premises. Employers may not deduct from a worker's wages for any time off of less than 30 consecutive minutes.

I worked over 45 hours last week but my employer said he doesn't have to pay over-time because we're a non union shop...is that true?


Your employer is most likely violating your labor rights. There are a few exceptions to the rule but see the following and follow the link for information at DWD's website.

The law requires that employers pay time and one-half the regular rate of pay for all hours worked in excess of 40 hours in the workweek. A "week" is the employer’s established regular reoccurring period of 7 consecutive days.
