We are currently conducting research on behalf of non profit employees. Specifically we are making inquiries to Wisconsin's DWD Unemployment Insurance and the liability/responsibility of non profits. The following questions were sent out on Friday, October 28, 2005 - It was resent to another department in the DWD on Wednesday, November 2, 2005 - When we get a response we will post those answers along with additional information and resources:

I am conducting some research regarding non profits and their responsibility/liability regarding unemployment insurance. The information from my research may be placed on the following web site:

I understand that Wisconsin Department of Workforce and Development recognizes non profits as described below:

A nonprofit organization is an organization described in Section 501(c)(3) of the Internal Revenue Code. (e.g. religious, charitable, educational organizations). A copy of the determination issued to the organization by the Federal Government establishing this status must be submitted to this department if you wish to be considered a nonprofit organization for UI purposes.

Questions:

1) Does the DWD UI verify the status of employers stating they are 501(c)(3)?

2) How does the DWD UI handle employers whose IRS 501 (c)(3) status has been revoked at the time of employment?

3) How does the DWD UI handle employers whose IRS 501(c)(3) has been suspended at the time of employment?...and does the length of an employers 501(c)(3) suspension have an impact on decisions?

4) If an employer is a 501(c)(3) but also conducts business that is not related to their charitable status and/or mission, and employees are also to carry out those duties, does that impact how the DWD UI handle non profit employers and their responsibility/liability? I can elaborate on this question if needed.

I realize that many claims are handled on a case by case basis, therefore the questions I have posed in this correspondence are not claim specific. I would appreciate your timely response to these questions. I would like to include your answers in future correspondence I may be issuing to various government agencies, legislators..(etc) as well as including them on the above listed web site. I plan to make a web page dedicated to non profit employees.
